KNOW ALL MEN BY THESE PRESENTS:

That Whereas, by Commercial Deed of Trust dated the 2nd day of February, 2018, of record in the Register's Office of Coffee County, Tennessee, in Trust Deed Book 1007, page 436, Nicholas Moscato did convey in trust to James J. Penland, Trustee for First Vision Bank of Tennessee - Tullahoma, the tract of land hereinafter described to secure the payment of the principal sum of One Hundred Thirty-Eight Thousand, Eight Hundred Ninety-Six & 49/100 Dollars ($138,896.49), evidenced by the certain Promissory Note in said Deed of Trust being incorporated by reference; and

Whereas, said Deed of Trust provides for the appointment of a Substitute Trustee; and by instrument of record in Trust Deed Book 1067, page 915, in the Register's Office of Coffee County, Tennessee, James D. Lane, II, has been duly appointed Trustee; and

Whereas, said Deed of Trust provides that in the event of default in payment of any of said note and interest, when due, the entire indebtedness shall, at the option of the holder and owner hereof, become due and payable; and

Whereas, default has been made in the payment of certain installments of said indebtedness now due on said Note, and the holder and owner of said Note has declared the entire balance, including penalty, cost and expense incident to foreclosure, now due and payable, and instructed the undersigned James D. Lane, II, Trustee, to foreclose the said Deed of Trust.

NOW, THEREFORE, by virtue of the authority in me vested as Trustee under said instruments, I will, on the 3rd day of January, 2020, offer for sale and sell at the South Door of the Courthouse in Coffee County, Tennessee at 10:00 a.m. to the last, highest and best bidder for cash in hand, and in bar of equity of redemption, homestead and dower, and all other exemptions of every kind which are expressly waived in said Deed of Trust, the following described tract of land situated in the Ninth (9th ) Civil District of Coffee County, Tennessee, and being more particularly described as follows:

Lying and being in the Ninth Civil District of Coffee County, Tennessee, and in the City of Tullahoma, and being Lots 5, 6 and 7, Block "G", W.A. King Subdivision to the Town of Tullahoma, Tennessee, according to a map or plat thereof of record in Trust Deed Book 55, page 232, Register's Office of Coffee County, Tennessee, to which reference is here made for a more complete description.

Being the same property conveyed to Nicholas Moscato by Warranty Deed of record in Deed Book 385, page 555, Register's Office of Coffee County, Tennessee.

This conveyance made subject to the following:

1. All matters as shown on map or plat of record in Trust Deed Book 55, page 232, Register's Office of Coffee County, Tennessee.

2. Stormwater Detention Facilities Construction and Maintenance Agreement with the City of Tullahoma, Tennessee of record in Trust Deed Book 891, page 91. Register's Office of Coffee County, Tennessee.

3. Any and all, recorded and unrecorded, easements, rights-of-way, reservations and/or other restrictions on the use of land held by a railway company as a result of subject property bordering railroad property.

4. Any and all, recorded and unrecorded, zoning regulations, building restrictions and setback lines, easements and rights of way for public utilities related to and affecting the described property.

This is improved property known as 990 East Decherd Street, Tullahoma, Tennessee 37388.

Said sale is made subject to any and all outstanding liens or encumbrances and/or any unpaid Coffee County and City of Tullahoma real property taxes and personal property taxes, including but not limited to the 2019 Coffee County real property taxes which are due and payable in the amount of $1,431.00; the 2019 City of Tullahoma real property taxes are due and payable in the amount of $1,347.47; the 2018 Coffee County real property taxes are delinquent and due and payable in the amount of $1,603.00 through October 2019 (base amount of $1,431.00); the 2018 City of Tullahoma real property taxes which are delinquent and due and payable in the amount of $1,509.15 through October 2019 (base amount of $1,347.47); the 2016 Coffee County personal property taxes are delinquent and due and payable to the Coffee County Clerk and Master in the amount of $98.07 through October 2019 (base amount of $30.00); the 2016 City of Tullahoma personal property taxes have been paid in the amount of $25.52; the 2017 Coffee County personal property taxes are delinquent and due and payable to the Coffee County Clerk and Master in the amount of $92.80 through October, 2019 (base amount of $30.00); the 2017 City of Tullahoma personal property taxes have been paid in the amount of $25.52; the 2018 and 2019 Coffee County personal property taxes are due and payable in the amounts of $30.00 (base amount of $27.00) and $27.00 respectively, through October 31, 2019 and the 2018 and 2019 City of Tullahoma personal property taxes are due and payable in the amounts of $28.56(base amount of $25.52) and $25.52, through October 31, 2019.

Said sale is subject to all matters as shown on map or plat of record in Trust Deed Book 55, page 232, Register's Office of Coffee County, Tennessee.

Said sale is subject to a Stormwater Detention Facilities Construction and Maintenance Agreement of record in Trust Deed Book 891, page 91, Register's Office of Coffee County, Tennessee.

Pursuant to TCA 35-5-104, the undersigned Trustee hereby gives notice that a Notice of State Tax Lien in favor of the Tennessee Department of Revenue on all property and rights to property belonging to N & J Transmissions, LLC has been filed in Lien Book 38, page 818 and in Lien Book 39, page 33, Register's Office of Coffee County, Tennessee. The undersigned Trustee affirmatively states that (1) the notice to the State of Tennessee required by TCA 67-1-1433(b)(1) has been timely given, and (2) the sale of the above-described property will be subject to the right of the State of Tennessee to redeem the land as provided for in TCA 67-1-1433(c)(1).
