NOTICE OF TRUSTEE'S SALE

WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated September 18, 2006, and the Deed of Trust of even date securing the same, recorded October 3, 2006, in Book No. T700, at Page 383, in Office of the Register of Deeds for Coffee County, Tennessee, executed by Terry Miller and Mala S Miller, conveying certain property therein described to All-Star Title as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for United Mortgage Lenders, Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Ditech Financial LLC.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Ditech Financial LLC, will, on January 6, 2020 on or about 10:00 AM, at the ffee County Justice Center, Manchester, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Coffee County, Tennessee, and being more particularly described as follows:

A certain tract or parcel of land located in the First (1 st ) Civil District of Coffee County, State of Tennessee, bounded and described as follows, to-wit: TRACT I: BEGINNING at the intersection at the southwesterly corner of said intersection and the driveway leading from the Harvey Miller residence with the intersection of the 50 foot driveway leading to the Nadeau property, thence South with the westerly margin of the 50 foot driveway leading to the Nadeau property 460 feet to the Nadeau line; thence in a westerly direction with the Nadeau northerly property line, 160, feet to the Nadeau corner; thence with the Nadeau line, South 400 feet to a corner; thence with the Nadeau line in a southerly direction, 82 feet to a creek; thence in a westerly direction with the creek, 485 feet to a point in the westerly line of Miller; thence in a northerly direction, 582 feet to an iron stake in the southerly margin of the driveway leading to the Harvey Miller residence; thence with the southerly margin of said driveway, 200 feet in an easterly direction to the point of beginning. TRACT II: BEGINNING at a point at the northeasterly corner of the property conveyed from Harvey Miller and wife, Dolly Miller, to T.J. Miller and wife, Dorothy Ann Miller, as of record in Deed Book 152, Page 569, Register's Office of Coffee County, Tennessee. This point also being the northwesterly corner of a 50 foot right of way granted to G. T. Nadeau and wife, Willie Jean Nadeau, as of record in Deed Book 145, Page 26, Register's Office of Coffee County, Tennessee; thence with the southerly margin of Cat Creek Road in an easterly direction a distance of 50 feet to a point, this point being in the Chumbley line; thence with the Chumbley line in a southerly direction 460 feet to a point at the northeasterly corner of the Nadeau property; thence with the Nadeau line in a westerly direction 50 feet to a point being the southeast corner of the grantees property; thence in a northerly direction running parallel to the Chumbley line, a distance of 460 feet to the point of beginning. The 50 foot strip described herein-above is the lane leading from the Cat Creek Road to the Nadeau property and this conveyance is made subject to the right of way over the 50 foot lane with was conveyed to G. T. Nadeau and wife, Willie Jean Nadeau, by Harvey Miller and wife, Dolly Miller, as of record in Deed Book 145, Page 26, Register's Office of Coffee County, Tennessee. TRACT III: BEGINNING at a stake located at the northeast corner of Plat and also being located 72 feet from the easterly margin of Cat Creek Road; thence South 51 degrees 18 minutes East 53.0 feet to an iron pin; thence with the line of Miller South 17 degrees 18 minutes West 242.1 feet to an iron pin; thence South 36 degrees 13 minutes East, 619. 2 feet to an iron pin; thence North 50 degrees 16 minutes West with the line of Roberts 248.5 feet to a Maple tree; thence North 64 degrees 16 minutes West 187.6 feet to an iron pin in the center line of a drive; thence North 55 degrees 29 minutes West, 250.4 feet to a stake; thence with the line of Plant, an agreed line, North 35 degrees 55 minutes East, 439. 5 feet to the point of beginning and containing 2.36 acres according to survey of W. C. Ingram, Tenn. Reg #214, dated August 11, 1983. EXCLUSION: There is included in Tract III, but to be excluded from this conveyance, the following described property located in the First (1 st ) Civil District of Coffee County, Tennessee, and more particularly described as follows: BEGINNING at an iron pin located in the Roberts line; thence North 50 degrees 16 minutes West 248.5 feet to a maple tree; thence North 64 degrees 16 minutes West 187.6 feet to an iron pin in the center line of a drive; thence in a northeasterly direction 202 feet to a point in the Miller line; thence South 36 degrees 13 minutes East, 547.2 feet to the point of beginning.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. The sale held pursuant to this Notice may be rescinded at the Successor Trustee's option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed for a period of two weeks. In such situations, notices will be mailed to interested parties of record.
