WHEREAS, by Deed of Trust (the ''Deed of Trust'') dated December 4, 2001, of record at Trust Book 514, page 201, Register's Office for Coffee County, Tennessee, MICHAEL J. SUTTON, C. JAMES SUTTON and wife, CAROLYN SUTTON, did convey unto JOE M. LAMBERT, JR., TRUSTEE, a certain tract of real estate hereinafter described, to secure a certain indebtedness set out in said Deed of Trust; and

WHEREAS, HERITAGE SOUTH COMMUNITY CREDIT UNION is the owner and holder of the note secured by said Deed of Trust hereinabove referred to; and

WHEREAS, the said real estate described in said Deed of Trust is as follows:

Certain tracts or parcels of real estate situated in the First (1st) Civil District of Coffee County, Tennessee, more particularly described as follows to-wit:

Being Lots No. 6 and 7 of the north block of the Forrest Wood Estates Subdivision as the same is shown by an unrecorded plat as surveyed by Claude Ingram, Coffee County Surveyor, on September 24, 1964. Same being more particularly described, to- wit:

BEGINNING at an iron pin in the north margin of Forrest Wood Drive, which point of beginning is located south 85 degrees 18 minutes east 550 feet along the north margin of said Forrest Wood Drive from the northeast corner of the intersection of Forrest Wood Drive into Hills Chapel Road; running thence from said point of beginning with the north margin of Forrest Wood Drive south 85 degrees 18 minutes east 200 feet to a stake; thence north 4 degrees 42 minutes east 350 feet to a stake; thence north 85 degrees 18 minutes west 200 feet to a stake; thence south 4 degrees 42 minutes west 350 feet to a stake in the north margin of Forrest Wood Drive, the point of beginning. The aforedescribed two lots form an aggregate tract of land fronting 200 feet on Forrest Wood Drive and extending back between parallel lines 350 feet.

Being the same property conveyed to C. James Sutton by Warranty Deed of record at Deed Book 126, Page 389, Register's Office, Coffee County, Tennessee.

This conveyance is subject to any and all existing easements and restrictions of record.

WHEREAS, said Deed of Trust was made to secure the payment of a note therein set out and contained the power to sell in the case of default in the payment of said note and interest at maturity; and

WHEREAS, the maker of said note has defaulted in the payment thereof, and the owner and holder of said note has declared the entire amount due and payable and has requested the undersigned to foreclose said Deed of Trust according to its terms in order to collect said note.

NOW, THEREFORE, I, the undersigned JOE M. LAMBERT, JR., TRUSTEE, will, in accordance with the terms set out in the Deed of Trust above referred to, on _ Wednesday, January 30, 2019, at 10:00 a.m, at the Coffee County Justice Center, 300 Hillsboro Blvd, Manchester, TN 37355, offer for sale and sell the above-described real estate at public auction to the highest and best bidder for cash in bar of equity of redemption and free from homestead and dower, all in accordance with the provisions of said Deed of Trust and the laws of Tennessee controlling such sales, subject, however, to all outstanding real estate taxes.

The right is reserved to adjourn the day of the sale to another day and time certain without further publication and in accordance with law upon announcement of said adjournment on the day and time and place of sale set forth above.

The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Trustee, be cause for rejection of the bid, and if the bid is rejected, the Trustee shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms thereof. The proceeds derived from the sale of the property will be applied as provided for in said Deed of Trust. Said Deed of Trust is made a part hereof as if copied verbatim herein.

This sale of the Property shall be subject to any and all unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens, and other superior matters of record which may affect said property; as well as any prior liens or encumbrances as well as priority created by a fixture filing; and/or any matter that an accurate survey of the premises might disclose. If the U. S. Department of Treasury/IRS, the State of Tennessee Department of Revenue, or the State of Tennessee Department of Labor and Workforce Development are listed as interested parties in the advertisement, then the Notice of this foreclosure is being given to them and the sale will be subject to the applicable governmental entities' right to redeem the property, as required by

26 U. S. C. 7425 and T. C. A. 67-1-1433. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed of Trust.

The address of the above described property is believed to be Forrestwood Drive, Manchester, Tennessee 33755, but such address is not part of the legal description of the property sold herein, and in the event of any discrepancy, the legal description herein shall control. This property is further identified as being Map 085O, Group A, Parcel 007.00, and Map 085O, Group A, Parcel 008.00, on the records of the Tax Assessor of Coffee County, Tennessee.
